Terms of Service

Effective July 14, 2026

These Terms of Service (“Terms”) govern your use of this website and any booking made with Altus Aerial Media LLC (“Altus Aerial,” “we,” “us,” or “our”) for aerial drone photography, videography, orthomosaic mapping, Giraffe360 interior capture, or related services (the “Services”). By submitting a booking request or engaging Altus Aerial, you (“Client”) agree to these Terms.

1. Property Access & Flight Authorization

By booking a flight, Client represents that they either own the subject property or have obtained explicit permission from the property owner to authorize drone flights over and, where applicable, interior capture within the property. Client is responsible for notifying tenants, occupants, or neighboring property owners as needed. Altus Aerial reserves the right to decline or halt a flight if authorization is unclear, airspace is restricted, or conditions are unsafe.

2. FAA Compliance, Weather & Rescheduling

All drone flights are conducted by an FAA Part 107 certified remote pilot in accordance with federal aviation regulations, including airspace authorizations, temporary flight restrictions (TFRs), and weather minimums. Altus Aerial has sole discretion to reschedule a flight due to weather, wind, visibility, airspace conflicts, or any condition the pilot in command determines to be unsafe or non-compliant. Weather-related rescheduling is offered at no additional charge.

3. Booking, Pricing & Payment

Prices shown on this site (including package pricing and add-ons) are starting estimates. A final price is confirmed after property details are reviewed and before the flight is scheduled. Payment terms are arranged directly with Client at the time of booking or upon delivery, as agreed between the parties. Altus Aerial reserves the right to require payment, in full or in part, prior to delivering final assets.

4. Cancellations & Rescheduling by Client

Client may reschedule or cancel a booking by contacting Altus Aerial as far in advance as possible. Cancellations or reschedule requests made with less than 24 hours’ notice, or a failure to provide agreed-upon property access at the scheduled time, may be subject to a rebooking fee to cover the pilot’s reserved flight window.

5. Turnaround Times

Delivery windows stated on this site (e.g., 24–48 hours) are targets, not guarantees, and may be affected by weather-related flight delays, the scope of a project, or circumstances outside our control. Rush delivery is available as a paid add-on where noted.

6. Ownership & Usage Rights of Deliverables

Unless otherwise agreed in writing, Altus Aerial retains copyright ownership of all photographs, video, floor plans, 3D tours, and mapping data it captures. Upon full payment, Client is granted a non-exclusive, perpetual license to use the delivered assets for the purpose they were commissioned for — including MLS listings, syndication, marketing, social media, insurance claims, or internal property records for the specific property captured.

Client may not resell raw or unedited files, represent the work as their own original photography, or use assets to market a different property than the one captured, without Altus Aerial’s prior written consent. Altus Aerial may use captured media in its own portfolio, marketing, and social channels unless Client requests otherwise in writing prior to the flight.

7. No Guaranteed Outcomes

Statements on this site regarding reduced days-on-market, increased buyer interest, or similar marketing claims are based on general industry trends and are not a guarantee of any specific result for Client’s property. Real estate outcomes depend on many factors outside Altus Aerial’s control, including market conditions, pricing, and listing strategy.

8. Limitation of Liability

Altus Aerial carries out all flights under FAA Part 107 with reasonable care. To the fullest extent permitted by law, Altus Aerial’s total liability for any claim arising from the Services is limited to the amount Client paid for the specific booking giving rise to the claim. Altus Aerial is not liable for indirect, incidental, or consequential damages, including lost profits or delayed sale of a property, except to the extent such liability cannot be limited under applicable law.

9. Indemnification

Client agrees to indemnify and hold Altus Aerial harmless from claims, damages, or losses arising from Client’s failure to secure proper authorization to fly over or capture interior imagery of the subject property, or from inaccurate information Client provides about property access, boundaries, or occupancy.

10. Third-Party Services

Interior capture services described on this site are performed using Giraffe360 hardware and software as part of Altus Aerial’s service offering. Altus Aerial is not responsible for the availability or performance of third-party platforms (such as MLS systems or social media platforms) Client chooses to publish deliverables to.

11. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Washington State.

12. Changes to These Terms

Altus Aerial may update these Terms from time to time. The “Effective” date at the top of this page reflects the most recent revision. Bookings made after a revision are governed by the Terms in effect at the time of booking.
